Commercial Recycling and Franchise Preparation

Client Needs

With its solid waste and recycling franchise set to expire in 2007, the City wished to negotiate a contract extension with Waste Management of Alameda County (WMAC), ensure that WMAC would continue to subcontract with a local non-profit (Tri-CED) for recycling services, increase diversion from the commercial sector, transition to single-stream recycling, utilize alternative fuel residential collection vehicles, and strengthen reporting requirements and assignment language.

HF&H Solutions

HF&H assisted the City and WMAC in designing new commercial recycling programs, and used comparable data from other jurisdictions to evaluate WMAC’s cost proposals to implement those programs.  HF&H assisted the City in negotiating and drafting a new and restated franchise agreement with WMAC.  HF&H provided examples from other franchise agreements, crafted a first draft of the agreement, and provided advice, editing, and review of selected sections for subsequent drafts.  The new agreement was drafted to extend the term of WMAC’s franchise and provide the City with the desired program enhancements.

Results

  • Residential programs were enhanced through the addition of alternative fuel (CNG and LNG) collection vehicles, single-stream recycling, and provisions for the addition of food scraps to residential yard trimmings.
  • Four new commercial recycling programs (commercial single stream, commercial organics, dry waste processing and wet waste composting) were included to the franchise agreement.
  • WMAC agreed to accept additional tons of biosolids, soil, and other City waste, and to provide free compost and self-haul coupons for residents.
